INDIANAPOLIS --- University of Cincinnati student-athlete Adam Hrycaniuk has been reinstated to play mens basketball for the school under the following conditions, the NCAA announced today.
Hrycaniuk will be required to sit out a season while losing a season of eligibility as a condition of his reinstatement due to amateurism issues involved with international competition. The student-athlete will have one season of eligibility remaining. This decision was first made by the NCAA student-athlete reinstatement staff and upheld by the NCAA Student-Athlete Reinstatement Committee.
Hrycaniuk, a transfer student-athlete, played in 39 games on a professional team in Poland prior to his enrollment at two different junior colleges. He then transferred to the University of Cincinnati.
According to the facts of the case presented by the University of Cincinnati, individuals on the team in Poland were paid above normal expenses, triggering the NCAA definition of a professional team.
"Clear guidelines for violations of NCAA amateurism rules have been established by and communicated to our membership," said Jennifer Strawley, NCAA director of membership services and student-athlete reinstatement. "Both the NCAA national staff and the reinstatement committee considered all factors presented by Cincinnati and attempted to find an avenue for relief, but after careful consideration given the student-athletes action of participating on a professional team the standard guideline was applied."
The Student-Athlete Reinstatement Committee originally heard the University of Cincinnatis appeal prior to Thanksgiving. Given the complex facts of the case, the committee requested additional information to assist in the deliberation of the case.
During the reinstatement process, the NCAA reinstatement staff considers a number of factors including guidelines established by the NCAA Student-Athlete Reinstatement Committee, any relevant case precedent, the student-athletes responsibility for the violation, as well as any mitigating factors presented by the institution.
The appellate body is the NCAA Student-Athlete Reinstatement Committee, an independent committee comprised of representatives from NCAA member colleges, universities and athletic conferences.
