NCAA Response to Inaccurate Statements Regarding University of New Mexico Investigation

Recent public statements by James Zeszutek regarding the enforcement practices during the University of New Mexico investigation are inaccurate. The NCAA is committed to fairness throughout its enforcement investigations. The role and responsibility of the enforcement staff is to gather the facts of the case for the Committee on Infractions, which makes the final determination on findings of violations and associated penalties. The enforcement staff is only interested in gathering accurate and truthful information throughout the investigative process. As such, false and misleading statements during the process only hinder the investigation.

The NCAA enforcement staff is upheld to a fair investigative process. NCAA rules ensure that copies of information pertinent to the investigation are made available to the institution and involved individuals as part of the enforcement procedures. Further, all individuals interviewed during an investigation are advised to the purpose of the interview.

As noted in the public report for this case, the committee found that unethical conduct against the two former assistant coaches for their role in knowingly being involved in NCAA rules violations, arranging for fraudulent academic credit and providing false or misleading information to the enforcement staff.
